  • Assembly Bill A11696: (Glick) Relates to public accountancy definitions, practice and licenses; allows for temporary practice permits; allows for non-attest services by out-of-state certified public accountants.
  • Senate Bill S07497: (LaValle and Stavisky) Relates to public accountancy definitions, practice and licenses.
  • Senate Bill S05240: (LaValle) Expands the regulated scope of practice; enhances due process in disciplinary hearing procedures; requires mandatory peer review; expands qualifying experience for licensure to include tax preparation and tax advisory services; requires continuing professional education for all CPAs, including those in industry; provides substantial equivalency and temporary practice privileges for out-of-state CPAs; and establishes standards for receipt of commissions and referral fees.

Professional Misconduct

  • Assembly Bill A03982: (Brodsky) Provides criminal and civil penalties for business entities and certain public service corporations engaging in professional misconduct in connection with the issuance of audited financial statements; expands the definition of professional misconduct for such purposes; prohibits (optionally) the investment of public pension funds in certain securities.
  • Assembly Bill A01568: (Englebright) Prohibits accountants from providing accounting services to any corporation, the shares and bonds of which are publicly traded, for 5 years after such accountant performs an audit on such corporation; authorizes the board of regents to promulgate any rules and regulations necessary for the implementation.

Compilations by Non-Licensees

  • Assembly Bill A0533: (Cahill) Exempts persons performing compilations or reviews from licensing as accountants and authorizes the use of statement to accompany their work products; permits the use of "enrolled agent" by persons authorized by the U.S. I.R.S; excluded from representation provisions designations authorized by a national credentialing body recognized by the state education department.

Tax Preparer Licensing, Refund Anticipation Loans and Consumer Bill of Rights
  • Senate Bill S02970 (Fuschillo) / Assembly Bill A06217 (Pheffer): Creates a consumer bill of rights regarding tax preparers; requires tax preparers to post on his or her business premises his or her license; requires the department of taxation and finance to produce an informational flier; provides for the licensure of tax preparers.
  • Senate Bill S01545: (Fuschillo) Creates a consumer bill of rights regarding tax preparers; requires tax preparers to post on his or her business premises his or her license; requires the department of taxation and finance to produce an informational flier; provides for the licensure of tax preparers.
  • Assembly Bill A01795: (Diaz R) Creates a consumer bill of rights regarding tax preparers; requires tax preparers to post on his or her business premises an identification and qualification statement; requires the department of taxation and finance to produce an informational flier; relates to refund anticipation loans and tax preparers; establishes penalties and civil causes of actions against violating tax preparers.

Investment Tax Credit

  • Assembly Bill A04548: (Schimminger) Provides a tax credit for certain investments in certified bank capital companies to provide venture capital for small business enterprises which have traditionally experienced difficulty in attracting institutional venture capital; creates a full framework for implementation.

Municipal Tax

  • Senate Bill S03146: (Schneiderman) Enacts the "urban and regional economic cooperation act of 2007"; imposes a tax on wages and self employment income earned within NYC by nonresident individuals, estates, and trusts; provides for withholding, disposition of revenues, and other procedural matters.
  • Senate Bill S03147: (Schneiderman) Imposes a tax on wages and self employment income earned within New York City by resident and nonresident individuals, estates, and trusts; provides for withholding, disposition of revenues, and other procedural matters; enacts the "emergency municipal services act of 2007"; tax liability accrues for a period of four years only.
  • Senate Bill S0492: (Bonacic) Relates to challenges made to review real property tax assessments made with respect to certain types of property; confers jurisdiction upon the independent division of tax appeals to conduct assessment review proceedings to challenge assessments made with respect to certain types of real property.

School District Accountability

  • Senate Bill S01773: (Saland) Provides for streamlining of planning and reporting requirements for school districts and boards of cooperative educational services; repeals provisions of the education law that require plans for reporting.
  • Assembly Bill A03258: (Pretlow) Grants a special apportionment to school districts having a population of between 195,000 and 219,000, for additional expenses incurred in the 2005-2006 and 2006-2007 school years associated with changes in public pension liabilities.
  • Assembly Bill A05277: (Fitzpatrick) Mandates the trustees of common school districts and the board of education of every union free school district to establish a code of ethics to be applied to the prohibition of the use of school resources for personal gain.
  • Senate Bill S04039: (Maltese) Creates the "class size reduction act"; provides for the contract for excellence and provides mandates for New York City; provides that the city school district of the city of New York shall spend no less than twenty-five percent of the additional amounts of such total foundation aid or grant on reducing the average class size on each grade in the city school district by the start of the 2011-2012 school year to not greater than one hundred five percent of the average class size of such grade in the state of New York, exclusive of New York City.
  • Assembly Bill A06063: (Lancman) Creates the "class size reduction act"; provides for the contract for excellence and provides mandates for New York City; provides that the city school district of the city of New York shall spend no less than twenty-five percent of the additional amounts of such total foundation aid or grant on reducing the average class size on each grade in the city school district by the start of the 2011-2012 school year to not greater than one hundred five percent of the average class size of such grade in the state of New York, exclusive of New York City.

Local Government Accountability

  • Assembly Bill A03815: (Calhoun) Permits town boards to complete the annual accounting within sixty days after the close of the town's fiscal year in conformity with section 30 of the general municipal law.
  • Assembly Bill A05750: (Sweeney) Requires written responses to reports of examination by the office of the state comptroller, reports of external audits performed by independent public accountants or management letters prepared in conjunction with such external audits.
  • Assembly Bill A01330: (Brodsky) Makes various provisions to reform local development corporations and industrial development agencies: conflicts of interest, standard tax exemption policies, municipal input, more information to be made public, economic impact statements, public hearings, and payment of prevailing wages.
  • Senate Bill S01717 (Winner) / Assembly Bill A0806 (Destito): Provides standards and procedures for determining whether or not a contractor is responsible for purposes of public construction projects.
  • Senate Bill S01854 (LaValle) / Assembly Bill A03553 (Magee): Provides that legislative bodies of municipal corporations may provide for the creation and/or extension of ambulance districts with elected commissioners; sets forth provisions relating to officers and their power and duties, taxes, expenses and dissolution.

  • Assembly Bill A02505: (DelMonte) Relates to travel by firefighters and ambulance workers.

Prevention of Financial Exploitation of the Elderly

  • Senate Bill S02256 (Klein) / Assembly Bill A01649 (Koon): Requires various persons (similar to child abuse) to report financial exploitation of the elderly (sixty-two or older) in violation of the penal law to a social services official, and provides for a cause of action for failure to do so; directs the commissioner of children and family services to develop rules for the conduct of investigations and the protection of the exploited.
  • Assembly Bill A03765: (Englebright) Relates to reporting of financial exploitation; and establishes a financial exploitation, outreach, education and training program and fund.
  • Assembly Bill A06519: (Englebright) Provides for a financial exploitation prevention outreach, education and training program and fund.
  • Senate Bill S03127A: (DeFrancisco) Provides for a financial exploitation prevention outreach, education and training program and fund.

Bills Which Include CPA Services

  • Assembly Bill A071: (Pheffer) Directs the triborough bridge and tunnel authority to issue short distance commuter passes (permitting travel at no charge between intersections and barriers in the permit area) on the Marine Parkway Bridge; permits a discounted charge if significant revenue loss results.
  • Senate Bill S02208 (Valesky) / Assembly Bill A0439 (Magnarelli): Authorizes and directs the thruway authority to issue annual short distance commuter permits for travel at no charge along the thruway in the Syracuse area.
  • Assembly Bill A02820: (Kolb) Enacts the drug-free workplace act to promote the goal of drug-free workplaces within government through drug testing; establishes rules for the use of drug testing in workplaces in the private sector; creates a drug offender punishment program for the rehabilitation of nonviolent felony drug offenders; provides for confidentiality of testing results; encourages employers to provide employees who have a drug problem with an opportunity to participate in an employee assistance program or an alcohol and drug rehabilitation program.
  • Assembly Bill A03431: (Brennan) Provides for creation of city public utility districts and provision of cheaper power by means of cooperation between city legislative bodies, PASNY and citizen participation; sets forth goal, definitions and provisions for permissive referendum; provides for capital improvements, creation and establishment of such districts, including contracts for provision of power, construction of facilities, filing of financial statements and just and reasonable charges.
  • Senate Bill S01723 (Bonacic) / Assembly Bill A03462 (Cahill): Creates the citizens` utility advocacy board, inc., a not-for-profit corporation to promote adequate representation of residential utility consumers; to collect operating funds; to assist in the redress of residential utility consumer complaints; and to provide for residential utility consumer membership in such corporation and residential utility consumer direction of the actions of such corporation.
  • Assembly Bill A03980A: (Brodsky) Enacts the "omnibus telecommunications reform act of 2007".
  • Assembly Bill A04658: (Espillat) Establishes the New York livery operators` injury compensation fund, inc.; provides for workers` compensation benefits to livery operators; establishes seven member board to manage the fund; requires all entities meeting the definition of livery car base to contribute to the fund; limits liability of the fund under workers` compensation law.
  • Assembly Bill A05602: (Lopez V) Provides that upon dissolution and prior to reconstitution to cooperative or condominium ownership, a Mitchell-Lama housing company aided by a loan made after May 1, 1959 must escrow 20% of the total of all accrued taxes for which an exemption was granted to make loans to eligible shareholders who are senior citizens, disabled or low and moderate income families in an amount equal to the increase in maintenance costs and other charges attributable to re-conversion to be repaid, with interest, upon sale of the unit.
  • Assembly Bill A06040: (Tonko )Directs the thruway authority to issue short distance commuter passes on the thruway in the Albany area which would provide for travel at no cost on the thruway between exits 23, 24 and 25.
  • Assembly Bill A07053: (Gordon T) Grants short distance commuter permits for thruway travel at no charge for commuters traveling in between permit areas between exits twenty-one and twenty-four as follows: 21, 21B, 21A, including B1, B2, and B3 of the Berkshire connector, 22, 23, and 24.
  • Senate Bill S0232: (Larkin) Makes health maintenance organizations subject to the same financial requirements under the insurance law as health insurers are subject to; increases solvency requirements for stock and mutual accident and health insurance companies, non-profit medical and dental indemnity corporations, and health and hospital service corporations; makes the provisions applicable to non-profit medical and dental indemnity corporations and health and hospital service corporations applicable to health maintenance organizations.
  • Senate Bill S03524: (Oppenheimer) Enacts the "Small Business Utility Boards Act"; creates one small business utility board as a not-for-profit corporation in each utility service area; promotes adequate representation of small business utility consumers; assists such consumers in complaint proceedings brought before government agencies; provides for the powers, functions and duties of such corporation.
